Terms

These Terms of Service (“Terms”) form a binding agreement between you and Sawary Trading LLC, a Wyoming limited liability company operating the Side-Eye brand (“Side-Eye,” “we,” “us”). Please read them carefully. By creating an account, placing an order, or otherwise using side-eye.co (the “Service”), you agree to these Terms. If you don’t agree, don’t use the Service.

Who you’re dealing with

The Service is operated by Sawary Trading LLC, a Wyoming limited liability company with its registered office at 30 N Gould St Ste R, Sheridan, WY 82801, United States. Side-Eye is a brand of Sawary Trading LLC.

Who can use Side-Eye

You must be at least 16 years old to create an account. You must be at least 18 years old (or the age of majority where you live, whichever is greater) to place an order or make any payment.

You also represent that you are not on any US Treasury, EU, UK, or other applicable sanctions list, and that you are not accessing the Service from a country subject to US sanctions (currently including, but not limited to, Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine).

Your account

To use most features, you create an account using your email address. We will email you a magic link to verify your address; clicking the link signs you in. You may also choose to verify your phone number using a one-time code (see Texts from us); this is optional but unlocks an additional credit grant.

You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. You agree to notify us promptly at support@side-eye.co if you suspect unauthorized access to your account. We are not liable for any loss caused by your failure to maintain reasonable account security.

One person, one account. You may not create or use multiple accounts to evade rate limits, credit limits, or content restrictions.

What you’re buying

The Service offers two kinds of purchases:

• Credit packs. Pre-paid credits used to generate personalized digital outputs. Sold via Stripe Checkout. Credits do not expire, are not redeemable for cash, are non-transferable between accounts, and remain valid as long as your account is active.
• Physical goods. Personalized printed items (framed prints, canvases, and similar) made to order based on your generated content. Sold and checked out via our Shopify storefront and printed and shipped by Printify.

Prices are listed in US dollars and exclude taxes and shipping unless otherwise stated. We may change prices at any time; orders already placed are honored at the price displayed at order time.

Refunds and replacements

All physical goods sold by Side-Eye are personalized and made-to-order. We do not offer refunds, returns, or cancellations once production has begun. Each item is printed specifically for you, contains content generated from your inputs, and has no resale value to anyone else.

Replacements for printing defects: If your item arrives with a verifiable printing defect (misprint, color error, damage in transit, wrong item shipped), we will work with our print partner Printify to replace it free of charge under their replacement policy. To request a replacement, email support@side-eye.co within 30 daysof delivery with a clear photo of the issue and your order number. Replacements are subject to Printify’s production and shipping timelines.

Credit packs are non-refundable once purchased, except where required by applicable law. Unused credits remain in your account and may be applied to future generations.

We may, at our sole discretion, issue a refund or credit in exceptional circumstances. Doing so once does not commit us to doing so again.

What you send us

When you use the Service, you may upload photos and provide text inputs (names, captions, themes, recipients). By submitting any input, you represent and warrant that:

• You either own the input or have all necessary rights, licenses, and consents to upload it and to allow us to use it as described in these Terms
• If a photo depicts a person other than yourself, that person is at least 16 years old (or has parental / guardian consent where they are between 13 and 15) and has consented to the photo’s use in this Service
• The input does not infringe any third party’s intellectual-property, privacy, publicity, or other rights
• The input does not defame, harass, threaten, or invade the privacy of any person
• The input does not violate any applicable law or these Terms, including the Banned subjects list below

You grant Sawary Trading LLC a limited, non-exclusive, royalty-free, worldwide license to host, store, transmit, process, and display your inputs solely for the purpose of operating the Service, generating the personalized output you ordered, fulfilling and supporting that order, and improving the Service in aggregated, anonymized form. We delete uploaded input photos within 90 days of order fulfillment unless you ask us to delete sooner.

We may refuse to process any input that violates these Terms. Our automated and human moderation may reject submissions that fail safety or policy checks; if we reject your submission, the credits used will be returned to your account.

Who owns what

What you own

You own the rendered final deliverable we produce for you (the PDF, PNG, and physical print) for your personal, non-commercial use. You may display it, photograph it, gift it, and post it to your own social media. You may not resell the design, sublicense it, or use it commercially without our prior written permission.

What we license from you

You grant us a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use anonymized samples of the content we generate for you (with personally identifying information — names, faces, recipient details — redacted, blurred, or composited) for the purpose of demonstrating the Service, marketing, social media, case studies, and improving our prompts and engines.

We will not feature you, your recipient, or your generated content in a named, identifiable, or testimonial-style way (including in our Hall of Fame) without your separate, explicit opt-in at the time of inclusion. The above license covers only anonymized use.

What we own

We own the underlying engine: the prompt templates, era and theme reference packs, brand voice, mascot (Iris), composition templates, and all related software and trade secrets. Nothing in these Terms transfers any ownership of these materials to you. The Side-Eye name, logo, and mascot are trademarks of Sawary Trading LLC.

Hall of Fame

From time to time we showcase customer creations in a public Hall of Fame. Inclusion is opt-in only. We will not feature your creation, your name, your recipient, or any identifying details in the Hall of Fame without explicit consent obtained at the time of inclusion. You may withdraw consent at any time and we will remove the entry within a reasonable period.

Texts from us

By providing your phone number on the verification step, you consent to receive automated transactional text messages from Sawary Trading LLC, sent through our verification provider Twilio, for the sole purpose of verifying your account (one-time codes). Message and data rates may apply. Frequency is rare: typically one message per verification attempt.

You can stop receiving verification messages by replying STOP to any message, by removing your phone number from your account, or by contacting support@side-eye.co. Reply HELP for help. Consent to receive verification messages is not a condition of any purchase, and you may use the Service without ever verifying a phone number (you simply don’t receive the optional +3 phone-verified credit grant).

We do not currently send marketing text messages. If we add marketing SMS in the future, it will be a separate, optional opt-in with its own consent flow.

Emails from us

We send transactional emails (order confirmations, shipping updates, magic-link sign-in, account notices) as a necessary part of providing the Service. You cannot opt out of these as long as you have an active account.

We send marketing email (newsletters, new product announcements) only if you have explicitly opted in. Every marketing email includes a one-click unsubscribe link in the footer, as required by the US CAN-SPAM Act. You can also email privacy@side-eye.co to be removed from marketing.

Banned subjects

The Service is built around humor that punches sideways, never down. To keep it that way, the Service refuses to generate content that targets or features:

• Body shape or weight as the punch line
• Aging as inherently negative
• Mental illness or addiction as the joke
• Death of a person
• Real political or religious figures by name
• Real, named celebrities
• Minors as the subject of any humor
• Race, ethnicity, sexuality, or gender used as the punch line
• Sexually explicit content, hate speech, threats, or content that promotes violence or illegal activity

You agree not to use the Service to attempt to generate, post, or distribute content that violates this list, and you agree not to attempt to circumvent our safety checks. We reserve the right to refuse, remove, or terminate access for any submission that violates this section.

What we promise

We will operate the Service with reasonable care and skill, process payments securely through our payment partners, ship your order through our print partners, respond to support questions in a reasonable time, and treat your data per our Privacy Policy.

What we can’t promise

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, Sawary Trading LLC and its officers, employees, and agents disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment.

We do not warrant that the Service will be uninterrupted, error-free, or secure; that AI-generated outputs will meet your subjective expectations; that printed items will be a perfect color match to on-screen previews (subject to the replacement policy above); or that the Service will be available in every country.

To the maximum extent permitted by applicable law, the total aggregate liability of Sawary Trading LLC and its affiliates arising out of or related to these Terms or your use of the Service is limited to the greater of (a) the amounts you paid us in the 12 months preceding the event giving rise to liability, and (b) one hundred US dollars (US $100). In no event shall we be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, goodwill, or data, even if advised of the possibility.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities; in those jurisdictions, our liability is limited to the smallest extent permitted by law.

Suspension and termination

We may suspend or terminate your account, with or without notice, for any violation of these Terms, for suspected fraud, for abuse of credits or refunds, or to comply with law. You may terminate your account at any time by emailing support@side-eye.co. On termination, in-progress orders will be completed where possible; unused credits are forfeited where termination is for cause and refunded only at our discretion.

Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Disputes

We’d rather solve a problem than fight about it. Please email legal@side-eye.co with any dispute first; we will try to resolve it informally within 30 days.

Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and you and we consent to personal jurisdiction and venue there. Either party may bring qualifying claims in small-claims court in their county of residence as an alternative.

Class actions are waived to the maximum extent permitted by applicable law: you and we agree that any dispute will be brought in an individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.

When these change

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. For material changes, we will post a notice on the site or email registered users at least 14 days before the change takes effect. Continued use of the Service after the change constitutes acceptance.
